Minimum Wage and Overtime


The federal minimum wage for covered nonexempt employees is currently $6.55 per hour, regardless if you are from Seattle or Timbuktu. So don't get undercut, get what you deserve.

These provisions are contained in the Fair Labor Standards Act (FLSA). Many states also have minimum wage laws. Where an employee is subject to both the state and federal minimum wage laws, the employee is entitled to the higher of the two minimum wages.

In addition, various minimum wage exceptions apply under specific circumstances to workers with disabilities, full-time students, youths under age 20 in their first 90 consecutive calendar days of employment, tipped employees, and student-learners. Unless specifically exempted, employees covered by the FLSA must receive overtime pay for hours worked in excess of 40 in a workweek at a rate not less than time and one-half their regular rate of pay. There is no limit in the FLSA on the number of hours employees aged 16 and older may work in any workweek. The FLSA does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest, as such.
